Terms of Service. The ground rules for our site.
The terms that apply when you use hestia360.com. Stays and services are covered by their own written agreements.
These Terms of Service ("Terms") govern your use of hestia360.com (the "Site"), operated by Hestia Hospitality LLC dba Hestia360 ("Hestia360," "we," "us," or "our"). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
1. Who we are
Hestia360 offers full property management, co-hosting, turnkey design and staging, and investment and acquisition help (finding and buying rental properties). Real estate brokerage services (buying, selling, or leasing property) are provided through Amazing Realty. Guests can also book furnished stays directly at the properties Hestia360 manages, including for insurance displacement, corporate relocation, and mid-term stays. The Site describes these services. It is not an offer to rent, sell, or provide any service on particular terms.
2. Using the Site
You must be at least 18 years old to book a stay or use our services. When using the Site, you agree not to:
- break any law or anyone else's rights;
- submit false information or impersonate anyone;
- interfere with the Site's operation or security, or try to gain unauthorized access to it;
- scrape, copy, or harvest content or data from the Site by automated means;
- use the Site to send spam or unsolicited messages.
3. Listings, availability, and pricing
We try to keep the Site accurate, but property descriptions, photos, amenities, ratings, availability, and pricing can change at any time and are not guaranteed. A home shown on the Site is not reserved until a booking is confirmed in writing. Photos may be illustrative. Rates, fees, and minimum stays are set in your booking or agreement, not on the Site.
4. Bookings and stays
Guests can book stays directly with us at the properties Hestia360 manages. Every stay, whether booked directly or through a listing platform, is also subject to the specific rental or lease agreement and house rules for that property and, if you book through a third-party platform such as Airbnb, VRBO, or Furnished Finder, that platform's terms. If those documents conflict with these Terms, they control for your stay. For insurance displacement stays, coverage decisions and payment terms are between you, your insurance carrier, and any agreement we sign with them; Hestia360 does not decide what your policy covers.
5. Property management, co-hosting, turnkey design and staging, and investment and acquisition services
These services are provided only under a separate written service agreement signed with Hestia360. Nothing on the Site creates a service relationship, and any fees, scope, or results described on the Site are general information only. We do not guarantee any level of occupancy, rental income, property value, or investment return, or that a suitable property will be found or acquired.
Information about markets, investing, and real estate on the Site is for general information only and is not legal, tax, financial, or investment advice. Talk to your own professional advisors before making decisions.
6. Real estate brokerage services
Real estate brokerage services, including help buying, selling, or leasing property, are provided by Amazing Realty (TREC License No. 9005035). Any brokerage relationship is created only by a separate written agreement and is governed by that agreement and Texas real estate law.
7. Scheduling and communications
When you submit a form or book a call through the Site, you agree that we may contact you by phone, email, or text about your request. Booking a call does not create a service agreement.
8. Text message (SMS) terms
If you opt in on our contact form or otherwise agree to receive texts, Hestia360 may send you conversational and service messages, such as replies to your inquiry, appointment and booking reminders, and messages about scheduled calls, bookings, stays, and customer care, and, only if you separately agree, marketing and promotional messages such as special offers, promotions, discounts, and updates.
- Consent to receive marketing texts is not a condition of buying any property, goods, or services.
- Message frequency varies. Message and data rates may apply.
- Reply STOP to opt out at any time. Reply HELP for help, or contact [email protected] or (512) 766-4353.
- Carriers are not liable for delayed or undelivered messages.
- No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties. See our Privacy Policy.
9. Intellectual property
The Site and its content, including text, photos, graphics, logos, and the Hestia360 name and marks, belong to Hestia360 or its licensors and are protected by law. You may view and print pages for your personal, non-commercial use. Any other use requires our written permission.
10. Your submissions
When you send us information, reviews, photos, or feedback, you confirm you have the right to share it and you allow us to use it to respond to you and to operate and improve our Services. We will not publish your name or review without your permission, other than reviews you post publicly on third-party platforms.
11. Third-party links and tools
The Site links to and embeds third-party services, including our property listings and booking widget, booking platforms such as Airbnb, VRBO, and Furnished Finder, scheduling and form tools, and maps. We don't control these services and are not responsible for their content, availability, or practices. Your use of them is governed by their own terms and privacy policies.
12. Disclaimers
The Site and its content are provided "as is" and "as available." To the fullest extent permitted by law, Hestia360 disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
13. Limitation of liability
To the fullest extent permitted by law, Hestia360 and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site. Our total liability for any claim arising out of or relating to the Site will not exceed one hundred U.S. dollars (US$100). This section does not limit liability that cannot be limited by law, and it does not change the terms of any separate rental or service agreement.
14. Indemnification
You agree to defend, indemnify, and hold harmless Hestia360 and its owners, employees, and agents from any claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms or of anyone else's rights.
15. Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Williamson County, Texas, and you consent to their jurisdiction.
16. Changes to these Terms
We may update these Terms from time to time by posting the new version on this page and changing the "Last updated" date. Continuing to use the Site after changes are posted means you accept them.
17. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and Hestia360 about your use of the Site. Separate rental and service agreements govern those relationships.
